The failure or delay on the part of Emirates Capital to exercise any right, power or option with respect to any breach of the Terms & Conditions by the User or any other person, or to insist upon the compliance with the Terms & Conditions, shall not constitute a waiver of the Terms & Conditions with respect to such breach or any subsequent breach, nor a waiver by Emirates Capital at any time thereafter to require strict compliance with all the Terms & Conditions.
3. Headings used in the Terms & Conditions are for convenience of reference only and do not affect the meaning of the Terms & Conditions.
4. If any provision of the Terms & Conditions (or any part of such provision) is or becomes illegal, invalid or unenforceable in any respect under the law of any jurisdiction, that shall not affect or impair the legality, validity or enforceability in that jurisdiction of any other provision of the Terms & Conditions (or part of such provision).
5. How we use the User’s information
This Privacy Notice tells you how Emirates Capital will collect and use the User’s personal data for the provision of financial services in Corporate Finance, Asset Management and Fund Management.
Why do we need to collect and store personal data?
We only collect information that the User voluntarily provides on or through this website. In order for us to provide the User with financial services in Corporate Finance, Asset Management and Fund Management we need to collect personal data (1) to communicate with potential and/or existing professional clients and/or market counter-parties; (2) to conduct detailed due diligence and KYC in line with the DIFC/DFSA regulatory requirements; (3) for other correspondence purposes and/or detailed provision of our services.
In any event, we are committed to ensuring that the information we collect and use is appropriate for this purpose, and does not constitute an invasion of your privacy.
If the User chooses to take advantage of some of the website’s features, the User may be asked to provide certain personal data. Such information may personally identify the User. For example, the User may provide us with the User’s name, title, first name / last name, email address, tel. and/or mobile number, job function, company name, mailing address, PO box, city, country, website address, etc and a message when the User submits a form through our "Contact Us" page or when the User submits a form through our “Investors Relations” page.
In terms of being contacted for marketing purposes Emirates Capital would contact the User for additional consent.
Will we share personal data with anyone else?
We may pass the User’s personal data on to third-party service providers contracted to Emirates Capital in the course of dealing with the User. Any third parties that we may share the User’s data with are obliged to keep the User’s details securely, and to use them only to fulfill the service they provide to the User on our behalf. When they no longer need the User’s data to fulfill this service, they will dispose of the details in line with Emirates Capital’s procedures. If we wish to pass the User’s sensitive personal data onto a third party we will only do so once we have obtained the User’s consent, unless we are legally required to do otherwise.
We may disclose personal data that we collect or that the User provides to: (1) our subsidiaries and affiliates; (2) contractors, service providers, and other business partners in order for us to provide services; (3) to a buyer or other successor in interest; and (4) third parties as permitted or required by law.
The User’s personal data may be stored and processed in any country in which we engage service providers. The User hereby consents to the transfer of that information to countries outside the country of the User’s residence.
How will we use the personal data we collected?
We will process (collect, store and use) the information the User provides in a manner compatible with the EU’s General Data Protection Regulation (EU GDPR). We will endeavor to keep the User’s information accurate and up to date, and not to keep it for longer than is necessary. We are required to retain information in accordance with the law, such as information needed for income tax and audit purposes. How long certain kinds of personal data should be kept may also be governed by specific business-sector requirements and agreed practices. Personal data may be held in addition to these periods depending on individual business needs.
Under what circumstances will we contact the User?
Our aim is not to be intrusive, and we undertake not to ask irrelevant or unnecessary questions. Moreover, the information the User provides will be subject to rigorous measures and procedures to minimize the risk of unauthorized access or disclosure.
What personal data of the User do we hold?
Emirates Capital at the User’s request, can confirm what information we hold about the User and how it is processed. If we do hold personal data about the User, you can request the following information:
(1) Identity and the contact details of the person or organization that has determined how and why to process your data. In some cases, this will be a representative in the EU.
(2) Contact details of the data protection officer, where applicable.
(3) The purpose of the processing as well as the legal basis for processing.
(4) If the processing is based on the legitimate interests of Emirates Capital or a third party, information about those interests.
(5) The categories of personal data collected, stored and processed.
(6) Recipient(s) or categories of recipients that the data is/will be disclosed to.
(7) If we intend to transfer the personal data to a third country or international organization, information about how we ensure this is done securely. The EU has approved sending personal data to some countries because they meet a minimum standard of data protection. In other cases, we will ensure there are specific measures in place to secure your information.
(8) How long the data will be stored.
(9) Details of the User’s rights to correct, erase, restrict or object to such processing.
(10) Information about the Users right to withdraw consent at any time.
(11) How to lodge a complaint with the supervisory authority.

(13) The source of personal data if it wasn’t collected directly from the User.
(14) Any details and information of automated decision making, such as profiling, and any meaningful information about the logic involved, as well as the significance and expected consequences of such processing.
